The Impeachment Chronicles: A Lawyer Dissects the Bush-Cheney Team

William Cox is a lawyer who specializes in criminal investigation. He currently serves as Senior Trial Deputy for the State Bar of California. Cox previously worked as a prosecutor, a public interest lawyer, and a law enforcement policy analyst.

Cox tackles the Bush Administration in the manner of a skilled prosecutor. His style is reminiscent of that of Vincent Bugliosi, also a former California prosecutor, in "The Betrayal of America" when he examined the egregious theft of the 2000 presidential election, taking particular aim at the United State Supreme Court majority that stopped an ongoing recount in Florida.

While Bugliosi presented an excellent brief in terms of that groundbreaking election, Cox covers it as well as what led up to Bush's selection, extending forward to a period in 2004 nearing the end of the first term of the Cheney-Bush Administration.

Cox recognizes, as does John Nichols, who wrote about the person really in charge, that Dick Cheney and the neoconservatives are the driving force in the Bush Administration. He examines the sordid route that brought the neocons to power.

Cox also explores the systematic character demolition of John McCain in South Carolina and the ensuing general election campaign when Al Gore was hideously misrepresented as untruthful while the smears and deception pattern actually came from the Bush campaign.

It is noted how Gore was misquoted on stating that he had invented the Internet and criticized unfairly over stating the name of the wrong person at FEMA during a debate with Bush, a common error under the circumstances.

It is also noted how elements of the media falsely accused the Democratic candidate of claiming to be the subject of Erich Segal's "Love Story" when all he did was react to a story that appeared in a Nashville newspaper.
Meanwhile the Bush campaign, aided by a helpful mainstream media, took the aforementioned and made a case for Gore being less than truthful.

Character was made an issue when Bush had on his resume a failed Texas oil venture in which he appears to have violated federal law and could have gone to prison if tried and convicted. He was spared further investigation by the Justice Department when his father, then President George H. W. Bush, terminated the effort.

There was also the matter of going AWOL from the Texas Air National Guard, which went uninvestigated by the mainstream media, and his reckless lifestyle that saw him drink heavily until the age of 40 and reputedly take drugs as well.

When an independent investigator learned about Bush's drunk driving arrest conviction and broke the story, this was denounced in many circles as a somehow unethical act by some of the same sources that looked the other way during the slimy South Carolina Republican Primary.

The title of Cox's book of "You're Not Stupid" is a theme he uses to denote how campaign operatives with huge advertising war chests financed by lobbyists have combined with commentators and journalists beholden to those same corporate interests to create false impressions, using 30-second sound bites to distort reality.

By using such tactics millions of Americans voted for George W. Bush in 2000 on the basis of character.

Cox warns Americans not to be fooled and study the issues themselves, hence the twin declarations of "you're not stupid" and "get the truth." The warning that Cox delivered can be analyzed alongside what millions of American voters did in the 2004 election.

Many voters revealed in exit polls that they voted for Bush because he made them feel safer and that they believed that Saddam Hussein actually possessed weapons of mass destruction. There was also a strong belief on the part of so many that there was a link between Saddam Hussein and Al Qaeda.

The author hones in on Bush early, delivering a zinging analysis in the first paragraph of the first chapter, which is entitled "Who's Bush?" Cox writes:
"How is it that a lying and denying alcoholic, with arrests for theft and disturbing the peace and a conviction for drunk driving; one born with a silver spoon in his mouth, with no empathy for the plight of ordinary people; an inarticulate spoiled brat who just didn't get the lessons of a good education; a chronically failed businessman who's never earned anything on his own; and a high school cheerleader who avoided military service in Viet Nam by joining the National Guard and then going AWOL-gets himself elected as President of the United States?
Well, you can be darn sure he didn't exactly tell us the truth about his background."

We are taken through Bush's first term as the disastrous tax cuts skewed toward the rich are examined. Cox also skewers Bush on his education proposals and his bizarre behavior during 9/11, along with that of Cheney, culminating with refusal to testify under oath at an official 9/11 commission convened only after pressures built to the point where the Cheney-Bush duo could no longer prolong such action.

Cox concurs with authors who believe that the official account released by the officially sanctioned commission does not answer vital questions pertaining to 9/11. He also believes strongly that an independent commission needs to be convened.

Cox's lawyer's analytical tools are never sharper when he approaches the subject of Bush and Cheney as violators of international law, as well as their repeated violations of the Bill of Rights alongside the efforts of willing Attorney General John Ashcroft.

This former prosecutor concludes that Bush, Cheney and other members of the Administration violated international law as well as engaging in unconstitutional acts in leading the country to war in Iraq.

The pattern of deception spearheaded by the full court press to conflict launched by neoconservatives within the Administration such as Paul Wolfowitz and Richard Perle is examined with microscopic clarity by a veteran attorney who can spot and document illegality when he sees it.
Let us hope that, as a trained prosecutor was able to discern the pattern of corruption within the White House that clearly warrants impeachment, that the timid and the frightened within the Democratic Party will also get the message.

Once again, the applicable rule is that when high crimes and misdemeanors are committed it is the duty of members of the House to impeach.
Even by itself, if taking a nation to war against a country that serves as no imminent threat and concerning which no discernible evidence exists of future dangers, to attack such a nation violates the United Nations and Nuremberg charters.

As a signatory to each of the above charters they become binding law. To contravene such binding law is unconstitutional and falls under the purview of "high crimes and misdemeanors" which is the guide to whether or not impeachment proceedings should be invoked.

At a time when American opinion is strongly against the Iraq War, Cheney, Bush and their cronies carry on without concern over the wishes of the people, or of the fact that the original vote empowering Bush to wage war under certain prescribed circumstances resulted from a steady and concentrated pattern of lies and cumulative deception.

Get in gear, Democratic Congress. The people voted for change because change was sought, specifically in Iraq. It is time to act!

What would the charges be? Launching a war based on lying to the people, incompetent and corrupt administration of the occupation after the war? Deceiving the people about conditions in Iraq and refusal to begin removing the troops when the public had made it clear that they wanted the war to end?

Those are substantially more serious matters than perjury in a civil trial. Are they valid reasons for removing a president? If a majority of the House should say that they are valid reasons, then they become valid reasons.

What better cause for dumping a president than monumental and stubborn incompetence, which has caused tens of thousands of deaths?

Neither the country nor the Congress is ready for such a battle now, though three-fifths of Americans wish his term were over.
When Rep. Robert Drinan introduced the first motion to impeach Nixon in 1973, it was quickly shunted off the agenda. Yet, a year later, it was voted out of committee and he left the White House. The Congress and the public had all it could take of Nixon.

Should the Iraq situation continue to deteriorate until the end of the summer, impeachment might make more sense than cutting funds for the war, though both Bush and Vice President Dick Cheney would have to be convicted of high crimes at the same time.

Alaska Congressman Don Young just attempted on the floor of the House to quote Abraham Lincoln's opinion on opposition to presidents' war plans.
Young failed rather dramatically.

Here's his misquote of Lincoln:

"Congressmen who willfully take actions during wartime that damage morale and undermine the military are saboteurs and should be arrested, exiled, or hanged."

That was close. You can see how Young could have made the mistake. Here's what Lincoln actually said:

"Allow the President to invade a neighboring nation, whenever he shall deem it necessary to repel an invasion, and you allow him to do so, whenever he may choose to say he deems it necessary for such purpose – and you allow him to make war at pleasure. Study to see if you can fix any limit to his power in this respect, after you have given him so much as you propose. If, today, he should choose to say he thinks it necessary to invade Canada, to prevent the British from invading us, how could you stop him? You may say to him, 'I see no probability of the British invading us' but he will say to you 'be silent; I see it, if you don't.' The provision of the Constitution giving the war-making power to Congress, was dictated, as I understand it, by the following reasons: Kings had always been involving and impoverishing their people in wars, pretending generally, if not always, that the good of the people was the object. This, our Convention understood to be the most oppressive of all Kingly oppressions; and they resolved to so frame the Constitution that no one man should hold the power of bringing this oppression upon us."

Lincoln wrote these words while America was at war with Mexico, under the presidency of James Polk, and while Lincoln was a member of Congress. But Lincoln did more than talk about the fraud that had been used to launch that illegal and imperialistic war. He introduced a resolution demanding that Polk provide proof. Polk claimed to have launched that war only after American blood had been shed on American soil. Lincoln's resolution required Polk to identify the spot where that blood had been shed.

"Let him answer fully, fairly, and candidly," Lincoln said of the wartime President. "Let him answer with facts and not with arguments. Let him attempt no evasion, no equivocation."

When President Polk did not answer, Lincoln and John Quincy Adams sought a formal investigation of the president's pre-war intelligence claims, and of his use of secret funds to launch his fraudulent and illegal war.
Under this pressure, Polk announced that he would not seek reelection. Lincoln, Adams, and their allies in Congress then passed a resolution honoring the service of Major General Zachary Taylor "in a war unnecessarily and unconstitutionally begun by the President of the United States."

President Polk's descendant William Polk has, by the way, authored a book with former Senator George McGovern outlining a plan to end the Iraq War. There's improvement of a sort that some prominent families can't compare to!

You can read a full account of the above series of events in John Nichols' masterful book "The Genius of Impeachment: The Founders Cure for Royalism," which makes a couple of important points that have been forgotten just as much as the sort of man Abraham Lincoln was has been forgotten:

1.-Impeachment usually achieves its purpose of preserving our democracy short of actually arriving at a majority House vote for impeachment.

2.-Pursuing impeachment when appropriate is the only politically safe thing to do. Voters do not reward cowardice.

Here are what I hope will be a few more tantalizing samples of what you will find in this book:

*-Our Constitution was written as Edmund Burke was leading the impeachment of Warren Hastings in England – an effort that did not achieve impeachment but did restore democratic checks on executive power.

*-American colonies impeached governors and justices.

*-The British Parliament has seen an active effort to impeach Tony Blair that has weakened his power.

*-When Democrats failed to pursue impeachment of Reagan for Iran Contra, so that they could win the next elections, they lost the next elections badly.

*-Bush will never again face an election. The same was true of Johnson, Truman, Nixon, and Clinton when those impeachment campaigns began.

*-The same Constitution that set up our elections schedule discusses impeachment in six places as the central means to maintain democracy between elections and avoid the "elected despotism" that Jefferson feared.

*-After the Whigs attempted to impeach Tyler, they picked up seven seats, and Tyler left politics.

*-Weeks after he lobbied for Johnson's impeachment, Grant was nominated for President.

*-Lincoln, too, was of course elected president.

*-Keith Ellison, who introduced a resolution to impeach Bush and Cheney into the Minnesota state legislature last year, was subsequently elected to Congress.

*-After the Republicans pursued impeachment of Truman and won what they wanted (and the nation needed) from the Supreme Court, they won big in the next elections.

*-Even during and following the unpopular impeachment of Clinton, the Republicans held onto power and lost fewer seats than is the norm at that point in a majority tenure.

*-Articles of impeachment have been filed against Tyler, Johnson, Cleveland, Hoover, Truman, Nixon, Reagan, Bush, Clinton, and Bush.

There are only two presidents who have ever been less popular with the American public than Bush currently is.
Both were unpopular for seizing too much power. They were Nixon and Truman.
In both cases, Congress began impeachment proceedings. In both cases, power was rightfully restored to the legislative branch of our government.
Neither Nixon nor Truman ever had remotely as much power or anywhere close to as low popularity as does Vice President Dick Cheney.

The Politico reported that today, two days after Saturday's Washington, DC, anti-war protests, "a small army of anti-war activists will fan out across Capitol Hill to lobby for congressional support to impeach...Bush, who's facing a storm of opposition for his handling of the Iraq war.

"I am ... unwilling to endorse demands for immediate bills of impeachment against Bush and Cheney, for the simple and compelling reason that such an approach is less likely to succeed. Recent history teaches us that the direct route to impeachment may not be the most effective.”
I wrote this, and believed this, last December 5. Intervening events, and some sober reflection, have convinced me that I was wrong. The intervening events. Since I wrote those words, Attorney General Alberto Gonzales has told the Congress, under oath, that the Constitution does not guarantee the protection of habeas corpus to the citizens of the United States.
If he believes this and acts accordingly, Gonzales has violated his oath of office. So too the President and Vice President if they endorse Gonzales’ opinion. Congress must demand that Bush, Cheney and Gonzales repudiate the Attorney General's pronouncement and reaffirm their oath to protect and defend the Constitution of the United States.
If they refuse, then they must be removed from office.In addition, both Bush and Cheney have expressed their determination to add more troops to the Iraqi occupation force, despite the opposition of the Joint Chiefs of Staff, an accumulating roster of the military, both active and retired, the Iraq Study Group, the American Public, and the Congress. By announcing that nothing, not even an act of Congress, will deter them, the Bush/Cheney team have, in effect, proclaimed themselves dictators.
If this proclamation is to fall short of an implementation of rule by decree, the Congress must promptly and decisively reinstate its co-equal status with the Bush Administration, and it must send back that message to the White House with an explicit threat of impeachment.Finally, over the past two months it has become apparent that Bush and Cheney might launch an attack on Iran.
Most informed observers agree that this would be an act of insanity, that would unite the world against the United States, probably sharply curtail the production and shipment of oil from the Persian Gulf throwing the US and the world into a depression, and just possibly igniting a third World War.
This attack might be prevented by an act of Congress refusing to fund such an attack and proclaiming explicitly that the Congress, in accordance with its Constitutional authority, forbids the President to launch an attack against Iran. That act of Congress should state that failure of the President to obey this act would result in impeachment.
There is no need for the Congress to “build a case” against Bush and Cheney. Two months ago, I believed that if Bush and Cheney were to be impeached and convicted by the Senate, investigations would have to take place, with the amassing of evidence, testimony under oath, and extended debate in Congress. Such was the case with Nixon and with Clinton.
However, I have come to realize that the situation today is substantially different. The evidence is public, indisputable, and even, in some cases, freely admitted by Bush and Cheney.
As John Dean has pointed out, when Bush announced that he had authorized secret wiretaps in direct violation of the FISA law, he had, in effect, confessed to an impeachable offense.
In addition, the use of torture violates the Geneva Conventions, and the launching of an aggressive war against a nation, Iraq, that did not attack or threaten to attack us, constitutes a war crime in violation of the Nuremberg Accords.
Both of these treaties have the force of law, and thus their violation merits impeachment.
Finally, Bush’s “signing statements,” many of which state explicitly a Presidential prerogative to ignore acts of Congress at will, contradict the Constitutional requirement that the President “shall take care that the laws be faithfully executed.
”There are many additional “high crimes and misdemeanors” that justify impeachment and conviction, but some of these require investigation and debate. However, those listed above are both indisputable and sufficient. All that remains, then, is the will of Congress to do its duty.
While extended debate on all these issues might be desirable under ordinary circumstances, these are not ordinary circumstances. The Bush/Cheney administration has caused enormous damage to the American economy, to its international reputation, and to its Constitutional order. And it appears quite likely that this administration is about to precipitate a calamity of unimaginable severity upon the nation and the world. Time is of the essence.Why not “impeachment now”?
In a carefully articulated essay in The Nation, Professor Sanford Levinson of the University of Texas Law School argues against impeachment, not withstanding his belief that Bush is “quite possibly the worst President in our history.” He raises three essential points:

· “The Constitution provides us with a language to get rid of a criminal President, but it provides us no language, or process, for terminating the tenure of an incompetent one.”

· “There is simply no possibility that Bush will actually be removed from office in the twenty-four months that unfortunately remain to him.”

· There is a “highly legalistic” question as to “what exactly constitutes ‘high crimes and misdemeanors,’” which the Constitution stipulates as grounds for impeachment.

I believe that all three objections can be successfully rebutted. If so, then given the gravity of the crimes and misdemeanors, only partially listed above, the impeachment of Bush and Cheney becomes both feasible and urgent.
First of all, Prof. Levinson appears to assume that there is a clear distinction between incompetence and criminality. But doesn’t criminal law recognize a crime of “depraved indifference” – which might amount to “voluntary incompetence”?
Granted that Bush is incompetent. But surely much of that incompetence is by his own choice – by his own culpable choice. Bush has spent an inordinate amount of time on vacation. He chooses not to study and deliberate about legislation and policy.
He refuses to accept advice or listen to contrary opinions, and those who dare disagree with Bush’s “gut” are summarily dismissed. All of these are indicators of Bush’s incompetence, yet he freely chooses each of them. And those choices constitute a willful “depraved indifference” to the duties and responsibilities of his office.
A “high crime and misdemeanor,” I would submit.Cheney, on the other hand, is not incompetent: he has proven himself to be extraordinarily skillful in achieving his diabolical objectives.
Thus he is even more culpable and vulnerable to impeachment than Bush.
As for the problem of “possibility:” I am reminded of a slogan from the World War II military: “The difficult can be done right away, the impossible takes a little longer.”
And history testifies to the success of numerous hopeless causes, and of the heroes that led these struggles, persevered and prevailed: Washington, Gandhi, King, Mandella, Sakharov. And do not forget, that Richard Nixon’s eventual departure began with a “third-rate burglary,” and no expectation of impeachment.
Then followed the firing of the Special Prosecutor, Archibald Cox and the disclosure of the White House taping system. In short, events often have a way of taking control, whereby "the impossible" may be transformed into "the inevitable."
No President and Vice President in our history have been more deserving of impeachment and removal from office. The case is strong, valid, public and beyond dispute.
If the public demands impeachment, as apparently more than half of the public does, and if the public makes this demand forcefully and persistently, it may eventually have its way.
Finally, there is the question of the “legalistic” question of just what constitutes the “high crimes and misdemeanors” that justify impeachment and conviction.While I am not qualified to dispute the learned law professor, I can cite several lawyers and law professors of a contrary opinion.
And as I vividly recall, from both the Nixon and the Clinton cases, the pronouncement by such experts was that “impeachment is a political, not a judicial, act.”
The Constitutional grounds, “high crimes and misdemeanors” are vague and even, in a sense, contradictory. Perhaps deliberately, so that the Congress might be empowered to deal with extraordinary emergencies.
In the body of law, “misdemeanor” means a petty crime, in contrast to a “felony.” So if misdemeanors are petty, how can there be a “high misdemeanor?” Is it not possible that the Framers of the Constitution meant by this phrase that a President might commit a grave offense against the Republic that does not fall directly under the body of law?
If so, who better to judge the severity of that offense than the body authorized to make and enact the laws – the Congress?
Professor Levinson writes, “thanks to the Founders, we were given a Constitution that perversely makes us ‘better off’ with a criminal in the White House instead of someone who is “merely” grotesquely incompetent.”
He neglects to mention a third possibility: a megalomaniacal President who is deranged to the point of near insanity, who is detached from “the real world,” who claims to be an instrument of the Almighty, and who is convinced that he can, by his will, create a reality of his choosing.
The Twenty-Fifth Amendment (1967) stipulates that the President’s cabinet and two-thirds of both houses of the Congress might declare such a President to be incompetent, over the objection of the President.
But what if that cabinet refuses to initiate this action?
Put bluntly, is Professor Levinson telling us that the United States, through its Congress, has no defense against a President run amok? Or a President surrounded by skillful lawyers who manage to keep the Chief Executive within the letter of the law, as that Executive proceeds to dismantle the law?
As this layman understands it, impeachment is an extraordinary procedure – a political act with few precedents and outside the strict letter of the law. To some degree, the Congress makes the law as the process goes forth. As the House of Representatives draws up articles of impeachment, and as the Senate deliberates its vote, there is no judge to rule on the strict legality of the articles or the legal propriety of the Senate’s vote.
Not the Chief Justice, who simply “presides” over the Senate trial. And there is no appeal to a decision of the Senate to remove a President, Vice President, or subordinate executive officials from their offices.

Perhaps the late Gerald Ford put it best: "...an impeachable offense is whatever a majority of the House of Representatives considers it to be at a given moment in history."
As the nation approaches the calamity that must surely follow an illegal and unprovoked attack against Iran, is there no escape?
Or are we about to discover that we have all booked passage on the Titanic, with a deranged captain locked in the bridge and determined to “stay the course”?
There is an escape, though it appears to be a long-shot.The Congress must, without delay, draw a line in the sand, and send a clear message to the White House: "You are hereby forbidden by law to launch an attack on Iran without the permission of the Congress. And if you do so, you will immediately face impeachment, trial, and removal from office."
We must not go gentle into that dark night that is directly ahead of us.
