In April of 2007, Representative Dennis Kucinich introduced House Resolution 333 calling for the commencement of impeachment proceedings against Vice President Cheney. On November 6, 2007, Representative Kucinich used his right of personal privilege to bring the resolution forward for a vote in the House of Representatives. Abandoned by the leadership of his own party, the resolution was referred to the Judiciary Committee without a vote.
Speaker of the House Nancy Pelosi, who continues to say that "impeachment is off the table," and other Demolican leaders hoped that the resolution would languish in committee. And, in fact, the resolution was seeming to die a quiet death until a few dissenters made their voices public.

Three members of the Judiciary Committee, Representatives Robert Wexler of Florida, Luis Gutierrez of Illinois, and Tammy Baldwin of Wisconsin, penned an op-ed piece in favor of Representative Kucinich's impeachment resolution. They approached several major American newspapers, including the New York Times, the Washington Post, and the Miami Herald, and each newspaper turned them down. Considering some of the editorials that have been published in these papers in support of the Bush Administration and their policies, the rejection of this impeachment op-ed should make us seriously question how "free" our press might actually be.
Yet, these three representatives refused to be silenced.

There are times when you have to think like a politician. And it says a lot about our system that these thoughts are generally unpleasant. In a world where a large percentage of political players are self-interested and more than a little corrupt, the "art of compromise" becomes the "art of compromise with real scum."Today, the Congress will begin debating a FISA bill that includes immunity for telecommunications companies. When Bush asked these telcoms to participate in warrantless wiretapping, he was asking them to break the law. The fact that the White House is insisting on the immunity is contrary to their claims that the program was entirely legal. If the telcoms are golden, there's no reason for the immunity.There's some question as to whether or not they'll get the cover. Sen. Russ Feingold writes:

I am all for impeachment but I am also a realist. Impeachment has been so politicized that it lost its edge as a legal tool. Also, what is being used to back up present calls for impeachment is in the eyes of many Americans – based on polls - a necessity of the times and thereby have political implications and some wiggle room.

We do not want the impeachment process to drag and end up with the likely slap on the wrist; we want the criminals, all of them, out of office and in jail.

Is there such a crime, so clearly apolitical, so clearly in violation of the legal code that would allow a meter maid in Washington, DC, to walk into the White House and march those guys to jail? The good news/bad news is, yes it exist.

The following are the two codes that were violated and the crime associated with each will follow:

The two U.S. Codes are the following: U.S. Code, Title 18, Part I, Chapter 115

§ 2381. Treason

Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.

And § 2382. Misprision of Treason

Whoever, owing allegiance to the United States and having knowledge of the commission of any treason against them, conceals and does not, as soon as may be, disclose and make known the same to the President or to some judge of the United States, or to the governor or to some judge or justice of a particular State, is guilty of misprision of treason and shall be fined under this title or imprisoned not more than seven years, or both.

The following is the count as I have conveyed it to five Federal Judges in the state of Connecticut:

"...,it is my duty to inform you..., of two counts of treason perpetrated by individuals high in the U.S. government. Such acts were done with premeditation.
The original crimes took place in New York, Virginia, and Pennsylvania on September 11, 2001; the attacks on the World Trade Center, Pentagon, the downing of a civilian airplane respectively. There is no need to name the victims individually; there were close of 3,000 deaths not to mention the other loses. The crimes I am reporting relate to how the U.S. government dealt with the criminal responsible for the original crime.

It is a natural tendency to remember the good and forget the bad. If that tendency is allowed to play out its course, George W. Bush and Richard B. Cheney may go down in history as two of the greatest leaders of all time because they initiated the first military action against Middle Eastern religious zealots commonly called “terrorists”. Terrorism must be stopped, but the methods used by Bush and his henchman, Cheney, were based upon violence against the American people, murder of innocent Middle Eastern civilians, cover-up of the truth, lies, torture, and wrongful detention and surveillance. No impeachment proceedings will expose the American people to similar despotism from its future leaders.

With the exception of Senator Frank Leahy’s leadership of the Senate Judiciary Committee that led to the resignation of Alberto Gonzales, the lawyer who condoned Bush’s wrongful action, the American government has failed to properly protect its citizens from harm.

1. Any Americans (OR residents who are non-citizens) who are serious about defending these United States should be willing to go on strike (and to boycott spending except for critically essential needs) until The House passes articles of impeachment against EITHER Cheney or Bush.

Contact every individual you know, every group you know, every union you know, and every place of worship you know. Urge them to think deeply about the constitutional crisis that the Bush Administration (and complicit members of Congress) have wrought upon us.

The ONLY power that We, the People retain in this era of corporate rule, elected and appointed officials breaking their oaths of office, and illegal law enforcement (including wiretapping) tactics against persons exercising their First Amendment rights... is the power to hit the ECONOMY via a comprehensive nationwide strike and boycott of non-essential spending.

Absolutely contact Chairman John Conyers (D-MI) Ph (202) 225-5126 Fax (202) 225-0072 John.Conyers@mail.house.gov He has long been asking for "proof" of public support for impeachment (even 'though activist groups have presented him with 1 million petition signatures). Although Rep. Conyers, with his previously aggressive investigations regarding impeachable offenses, has been cowed by the Democratic leadership (e.g., Speaker Pelosi), in 2006 he said (per John Nichols' book, THE GENIUS OF IMPEACHMENT: The Founders' Cure for Royalism), "I have a choice. I can either stand by and lead my constituents to believe I do not care that the President apparently no longer believes he is bound by any law or code of decency. Or I can act."

Note this statement (http://www.bradblog.com/?p=5256 ) from a Judiciary Committee spokeswoman, in response to the referral of the Impeachment resolution to the committee:

"The Committee has a very busy agenda - over the next two weeks, we hope to pass a FISA bill, to vote on contempt of Congress citations, pass legislation on prisoner re-entry, court security and a variety of other very important items. We were surprised that the minority was so ready to move forward with consideration of a matter of such complexity as impeaching the Vice President. The Chairman will discuss today's vote with the Committee members but it would seem evident that the committee staff should continue to consider, as a preliminary matter, the many abuses of this Administration, including the Vice President."

Tell them that you want Cheney impeached NOW! That no matter is more important (Cheney wants to bomb Iran! I believe he has already tried: http://www.thiscantbehappening.net/?q=node/57 ). That extensive investigations have already been conducted by the House Judiciary Committee regarding the impeachable offenses of this Administration and a 350+ page report written by Rep. Conyers' staff in 2006! That you support Dennis Kucinich's (D-OH) H.Res. 799 (formerly H.Res. 333) and request the Committee to urgently begin inspecting its Articles of Impeachment against VP Cheney.

Now is the window of opportunity. Keep the pressure on these members to whose hands this impeachment bill has returned.

Speak in the language they understand--impact upon elections. Remind them that the Democrats held Nixon to account and won. They let Reagan off easy and lost.

The Republicans went after Truman and won. They went after Clinton despite public opposition and still held onto power and began expanding it.

If the Democrats do not act to impeach, voters now see clearly that they support the Iraq War and the Bush Administration. When election day comes, many voters will likely just stay home if impeachment has not taken place.

On Tuesday, Speaker Pelosi's assignment to Rep. Hoyer to motion to table / kill Kucinich's Resolution of Privilege surprisingly failed due to the eventual Republican strategy to allow a debate, intended to embarrass the Democratic leadership, But so set against this were Pelosi and Hoyer and their ilk, that they motioned to return Kucinich's bill (now H.Res. 799) to the Judiciary Committee.

And ALL Democrats EXCEPT FOR Dennis Kucinich, Bob Filner, Marcy Kaptur, Maxine Waters, and Ed Towns shamefully agreed by vote with the Democratic leadership!

Regarding the elections, Anthony St. Martin has, as the informed free thinker he is (unaffected by the corporate media), long said that Rudy Guiliani may win in '08.

"The Democratic strategy for the 2008 election has been to do nothing overly confrontational, to pass no significant legislation, to collect lots of money from corporate interests, and to hope that the Republican Party, saddled with an unpopular administration and an unpopular war, will implode.

The strategy, however, is proving to be a disaster, as public support for the Democratic do-nothing Congress has fallen even below the President’s record low numbers. Just running against Republicans, Bush/Cheney, and the continuing war risks seeing Democrats go down to defeat in ’08.

The chart below shows how each Representative voted on tabling H Res 799, the new Kucinich bill to impeach Cheney. This was the first vote of last Tuesday.

A nay vote is a vote to debate impeachment of Cheney on the floor, rather than to table. Here you can see if your Democrat voted the party line- yes, to table, or no, to debate. You can see the Republicans who voted to debate, to embarrass Pelosi. H Res 799 was eventually referred to Judiciary.

For those in CA District 1, Mike Thompson voted to debate, not table, thus breaking with Pelosi's leadership. Of interest, John Conyers voted no on tabling. Pelosi didn't vote.

CAMPAIGN OUTLINE:

Read and get your facts, telephone talking points and writing points organized.

Call your member(s) on the Committee, followed by your Representatives who may not hold such a position. It does not matter whether they are Democrats or Republicans because all 435 House seats are up for election in November of 2008. They are all vulnerable. This they will understand!

Write the members of the Judiciary Committee, (Email and/or Fax).

Turn that letter into a “LETTER TO THE EDITOR” sent to appropriate local news outlets as an “OPEN LETTER TO: so-and-so”.

Do the same for Speaker Pelosi, Majority Leader Hoyer and Chairman Conyers. The follow up “Open Letters” for these individuals should be sent to their local news outlets and the DC Area outlets most notably The Washington Post.

Some tailoring of your letters may be necessary. Do not send “Letters To The Editor” off in batches lest the outlets may see that and shy away from publication of identical or duplicated messages!

If you have additional channels to reaching any member of the House, i.e., personal, campaign personnel, local appearances USE THEM!

Get the message out in whatever manner you can AFTER you make the direct contacts and cover the media!

In contacting any supporter of original H. Res. 333; please extent your thanks, encourage his/her continued actions a pledge of your personal support and endorsement.

Although the political machinations of Tuesday November 6 indicate that the Democratic leadership hopes Kucinich's bill will again be put on the shelf by a subcommittee of the Judiciary Committee (as it was last May by Rep. Conyers and Rep. Nadler), the tide seems to be changing!

We need to see to it that the tide washes Cheney out of the White House!

The next day (Nov. 7), 6-term Rep. Robert Wexler (D-FL), emailed his constituents:

“I share your belief that Vice President Cheney must answer for his deceptive actions in office, particularly with regard to the preparations for the Iraq war and the revelation of the identity of covert agent Valerie Plame Wilson as part of political retribution against her husband.

…Cheney and the Bush Administration have demonstrated a consistent pattern of abusing the law and misleading Congress and the American people. We see the consequences of these actions abroad in Iraq and at home through the violations of our civil liberties. The American people are served well with a legitimate and thorough impeachment inquiry. I will urge the Judiciary Committee to schedule impeachment hearings immediately and not let this issue languish as it has over the last six months.


Only through hearings can we begin to correct the abuses of Dick Cheney and the Bush Administration; and if it is determined in these hearings that Vice President Cheney has committed High Crimes and Misdemeanors, he should be impeached and removed from office. It is time for Congress to expose the multitude of misdeeds of the Administration and I am hopeful that the Judiciary Committee will expeditiously begin an investigation of this matter.”

Also in the wake of Tuesday, Carol Shea-Porter, a first-term Representative (D-NH), characterized the sending of Kucinich's bill, now H.Res. 799, to the Judiciary Committee as a “strongly bi-partisan vote.”

In explaining her own vote, she said:

“It is the duty of the Vice President to faithfully execute the laws of the United States of America and to defend the Constitution. There is growing evidence that the Executive Branch has ignored some of our laws and has attempted to bend the Constitution to its will. Members of both parties decided that this issue is too important to ignore. I voted with my Republican and Democratic colleagues to investigate the Vice President’s actions in office.”

And Rep. Stephen Cohen (D-TN), a member of the Judiciary Committee and a co-sponsor of the H.Res. 333 said that he expects there to be an impeachment hearing in the Committee.

Dear Congressman Hoyer,

As a Democrat, I write to you, our Party’s House Majority Leader, because of the considerable influence you have in this Congress. I am dismayed and disgusted by your current refusal to investigate and confront, via Impeachment, the violators of our Constitution.

With the introduction of articles of impeachment by Congressman Kucinich on Tuesday, November 6, 2007, you are presented with an historic opportunity to act on your oath to defend the Constitution. I DEMAND you seize this opportunity.

Support the resolution calling for the impeachment of Vice President Dick Cheney that is now awaiting action in the Judiciary Committee.

Heed the call from a Democratic member of the committee, Congressman Robert Wexler of Florida.

Listen to the plea of Congressman Kucinich. He may not be the voice of our party, but he has surely become the soul and conscience of our party. His integrity is intact.

The American people are served well with a legitimate and thorough impeachment inquiry. I will urge the Judiciary Committee to schedule impeachment hearings immediately and not let this issue languish as it has over the last six months. Only through hearings can we begin to correct the abuses of Dick Cheney and the Bush Administration; and, if it is determined in these hearings that Vice President Cheney has committed High Crimes and Misdemeanors, he should and must be, impeached and removed from office.

It is time for Congress to expose the multitude of misdeeds of the Administration, and I am hopeful that the Judiciary Committee will expeditiously begin an investigation of this matter.

Do not continue to betray Your Constituents! Do not continue to betray our party. Failure to act in a manner which supports our Constitution and the most fundamental laws of this land will only expose more weakness and lack of backbone on the part of the Democratic Party leadership. It will only serve to fuel the growing contempt of we Democratic voters that you depend on for your position.

Fail us now, and we will not be there. We will find ourselves with no other choice than that of departing from the party and opposing all who fail to uphold their oath of office and are not willing to do the bidding of the people.

The people are not afraid of the consequences of impeachment of this Vice President; the polls show they are firmly behind his removal.

Your stated fear that hearings will backfire in an election year has lost credibility and support. You have lost credibility and the respect of far too many Americans in general and within our party in particular.

Open hearings so we may begin the process of the restoration of our party and the salvation of this nation. To do less is to will contribute further to the irrelevance of our party.

This matter is not only of party concern; it is a Constitutional crisis that threatens the very integrity of our American institutions and Democratic fabric. To ignore the truth by inaction and excuse is a course of action in and of itself criminal.

Exposure of the Vice President’s many misdeeds will enlighten others to the damage that is being done in our name, and to our Constitution, will create the ground swell necessary to move the Senate to impeach.

By opening hearings in the House you begin that process, moving our nation out from under the cloud of this administration. I am in earnest when I say to you that I will oppose every member of the House who does not support this move. That is my right. We empowered you; we elected you and we can remove you, and we are prepared to do just that is you are not loyal to this nation and faithful to your oath.

This nation is more important than you, more important than any election; more important than any party.

Should you stop Kucinich’s resolution in committee, you will fail your own oath of office: “To defend the Constitution from all enemies foreign and domestic.” With such precedent, you will allow this current administration - and any future White House - to commit additional high crimes and misdemeanors without consequence. Do you really want the Democratic Party to be a co-conspirator in the continued dismantling of the Constitution and the Bill of Rights?

The remedy to the abuses of the Bush administration is in the Constitution. The Congress has the power to impeach the Vice President, and the President - Use It! Failure to act is irresponsible, unacceptable. It will not be forgiven, forgotten or be without consequences.
